Terms of Service

Welcome to Markout. These Terms of Service (“Terms”) govern your access to and use of the Markout platform, websites, and services (the “Service”). Markout is a product of 007 Technologies LLC (“Markout,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
3. The Service
Markout provides free, AI-graded mock interviews and related practice tools for consulting and investment-banking preparation. Scores, feedback, and rankings are generated by automated systems and are provided for practice and educational purposes only. They are not a guarantee of performance in any real interview, and are not career, financial, or professional advice.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its systems.
- Upload content that is illegal, infringing, harassing, or that you do not have the right to share.
- Resell, sublicense, or commercially exploit the Service without our written permission.
- Misuse AI features, including attempts to manipulate grading or extract underlying models or prompts.
5. User Content
You retain ownership of the content you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use your User Content as needed to operate, provide, and improve the Service. You are responsible for your User Content and represent that you have the rights necessary to submit it.
6. Intellectual Property
The Service, including its software, content, design, and trademarks, is owned by Markout or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in and to the Service.
7. Free Service and Changes
The Service is currently offered free of charge. We may modify, suspend, or discontinue any part of the Service at any time, and may introduce new features or paid offerings in the future. We will provide notice of material changes where required.
8. Third-Party Services
The Service may rely on or link to third-party services (such as AI providers and hosting). We are not responsible for third-party services and your use of them may be subject to their own terms.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED FEEDBACK WILL BE ACCURATE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKOUT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
11. Indemnification
You agree to indemnify and hold harmless Markout and its affiliates from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and request account deletion at any time.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which 007 Technologies LLC is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless otherwise required by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
